LP Planning was instructed to assist a client in securing a Certificate of Lawfulness of Existing Use or Development (CLUED) for a former paddock adjoining their home that had been used as part of their garden. CLUEDs are required where development or changes of use have taken place without prior planning permission, often due to a lack of awareness that permission was needed.
In this case, the paddock had been used continuously as a garden for over ten years, exceeding the time period for enforcement action. LP Planning prepared a detailed application with comprehensive supporting evidence to demonstrate the lawful use. Despite this, Wiltshire Council refused the application, and the client instructed LP Planning to submit an appeal.
The appeal, managed entirely by LP Planning, was ultimately successful, with the Inspector’s decision strongly supporting the client’s case, a positive outcome despite the need to pursue the appeal route.
